A Ninth Circuit court on Monday went against a Berkeley ordinance that banned natural gas piping in new buildings inside the city. A district court had dismissed an action from the California Restaurant Association, a dismissal that is now reversed by the Ninth Circuit court, according to its published opinion on the case (pdf). The California Restaurant Association alleged that the Energy Policy and Conservation Act preempts the city of Berkeley’s regulation, which banned natural gas piping in new buildings. The Act expressly preempts State and local regulations on the energy use of natural gas appliances used in household and restaurant kitchens, according to the Ninth Circuit judges’ opinion on Monday.

Japanese Prime Minister Fumio Kishida escaped harm earlier today after a man holding what appeared to be two pipe bombs threw one near Kishida. Remarkable video from the event showed citizens and police apprehending the suspect after one of the devices was thrown. Jack Teixeira, the 21-year-old Massachusetts Air National Guardsman accused of leaking a trove of classified military intelligence, was charged Friday in federal court with “retention and transmission of national defense information and willful retention of classified documents.”(snip)Teixeira became a National Guard “cyber transports systems journeyman”—which is similar to an information technology specialist—in February and started leaking highly sensitive military documents to his small Discord chat group in early March, according to the New York Times. Until I saw the document labeled, CIA Operations Center Intelligence Update, I was inclined to believe that the leaked documents were the work of a frustrated whistleblower. But I have changed my mind. The rare, relaxed private family portrait was taken by royal photographer Chris Jackson to mark the monarch's 70th birthday in 2018.
