A Ninth Circuit court on Monday went against a Berkeley ordinance that banned natural gas piping in new buildings inside the city.
A district court had dismissed an action from the California Restaurant Association, a dismissal that is now reversed by the Ninth Circuit court, according to its published opinion on the case (pdf).
The California Restaurant Association alleged that the Energy Policy and Conservation Act preempts the city of Berkeley’s regulation, which banned natural gas piping in new buildings.
The Act expressly preempts State and local regulations on the energy use of natural gas appliances used in household and restaurant kitchens, according to the Ninth Circuit judges’ opinion on Monday.
Amid calls from former President Donald Trump to “defund” the partisan Department of Justice and FBI, which treats its friends above the law and its enemies below it, Senate Majority Leader Chuck Schumer defended the agencies.
But a review of the agencies’ track records shows them to be indefensible. Here are 19 times Democrats and DOJ politicized the rule of law, deploying federal resources to do Democrats’ bidding.

A Manhattan federal judge on Thursday allowed attorneys of former President Donald Trump to depose, for questions related to witness credibility, E. Jean Carroll, a writer who accused Trump of sexual assault and defamation.

As his unit provides intelligence for combat support and homeland security, Teixeira was granted a “top secret security clearance” in 2021.

Budweiser has released a new patriotic advertisement as its parent company struggles with controversy over its endorsement partnership with transgender influencer Dylan Mulvaney.
