The problem with the courts is the same as the problem with many of our other institutions. Called the Skinsuit Phenomenon, after the great @Iowahawk’s famous tweet that perfectly sums up the leftist approach to marching through our society: “1. Identify a respected institution. 2. Kill it. 3. Gut it. 4. Wear its carcass as a skinsuit, while demanding respect. #lefties.” The courts are supposed to have respect because they’re supposed to do their job, but, as is so common these days, they’re not doing the job, yet they still expect the respect. That’s just not in the cards.

In Texas, all judges, from the Texas Supreme Court and Court of Criminal Appeals down to your local J.P., are elected by the people. About every 20 to 25 years someone in Austin has the bright idea that Texas should amend its constitution to do away with elected judges and have them appointed. The suggestion generally goes nowhere, because to amend the Texas Constitution would require, first, a vote of the legislature to pass the proposed amendment and put it on the ballot, and second - winning a majority of the vote of the citizens of Texas in a general election. Ain't gonna happen. We like being able to boot the judges out if they get too weird. In an earlier generation, when the 'appointed judges' suggestion was made, it was answered with one name: William Wayne Justice. He was a federal district judge here in Texas who loved to put his finger into everything. One of his less important decisions (but quite memorable to Texans) was his mandating from the bench exactly how a certain high school was to go about selecting cheerleaders. Cheerleaders relate to football, and high school football is like the third leg of the trinity - God, Country, high school football. And William Wayne Justice was there for life, and there was NOTHING us regular mortals could do about it. So, yeah, we'll keep electing our judges here in Texas, thankyavermuch.

FTA: "But you don’t get to vote on federal judges even when they act like politicians. If a branch is going to be political, it has to be accountable."
Kurt Schlichter is spot on here. Republicans let this happen. SCOTUS is culpable. It must stop!

Supreme Court justices are supposed to read election results. Apparently last November 5 they were fast asleep. IMO, the situation is fast coming to a point where the President should simply ignore them and act in accordance with his Article II powers. Force the SCOTUS to get off the fence. The people are with him.

Apologize for the second post, but I litigated Crowder v. Sinyard (wrongful police search and seizure case) in his court the Monday after he appeared on 60 Minutes in a piece condemning "police brutality," #1. A real piece of work, but got him reversed at the Fifth Circuit (Supremes denied cert.).

Really, Schlichter, courting disaster? When all federal judges are appointed for life? Other than some crazy ostensibly linked to our side assassinating one of these 'judges', we have to either wait for one of these judges to croak or hope we have a super-majority in the US Senate to impeach them out of office. Aint gonna happen, Kurt. So unless Chief Justice Roberts grows a new set of cajones, these lawfare judges are unstoppable.

I agree all judges should be elected. It is a ruse to say judges are not politicians. Every single one of them is a politician, appointed by a politician, because their beliefs are thought to coincide with that politician.

Time to start recalling these judges. There has to be a way to do it. None of those guys were elected and they are supposed to adjudicate the laws not override them
