A judge in Lonoke County, Arkansas, on Thursday dismissed second-degree murder charges against Army veteran Aaron Spencer, who was facing charges for fatally shooting Michael Fosler, who allegedly sexually abused and kidnapped his minor daughter.

The Arizona Supreme Court declined to review lower court decisions that sent the state’s case back on due process grounds. Just minutes after the ruling, a spokesman for Mayes’ office said she “will take the case back to a grand jury to seek new indictments.”

The resolution is likely dead on arrival in the Senate. If it passes the Senate, Trump will veto the resolution.

The scene at the warehouse appeared at odds with the mounting pressure to process hundreds of thousands of remaining ballots.
