Before getting into the weeds, here’s the big picture baseline. All documents and records created within the executive branch are created for the benefit of the head of the Executive Branch, the president. There is no entity, organization, assembly, institution, person or individual, above the President of the United States. The president holds absolute power and absolute immunity. Everyone within the executive branch works at the pleasure of the president, and all work products are created for his administration. This is the plenary power of the president.

Keep in mind...none of the documents Trump had were the ONLY copies of any documents, merely his personal copies...EXCEPT...The private letters he received from Presidents Xi, Obama, and others, that he had framed in his private office, Which Smith etal are CHARGING him with keeping away from the archives librarian, and calling Top Secret National Security documents..

Ruh Roh, so 45, as President, could declare the documents he had - his documents. There is no one individual nor government entity above the President, as President, 45 had the last word about the documents. The National Archivist is not above the POTUS. Pretty much, pure and simple, and easy to understand. A reasoning even a dumb jury should be able to understand.

Good- if they are mad then the correct decisions are being made. The judge is probably following the constitution exactly as written - because we all know how much liberals hate the constitution and want decisions to be made based on feelings and their political agenda.

There is only one thing that supersedes the decisions and authority of the President. That is the will of the People as expressed through legal and constitutional channels. For any other entity within the Executive it is like the speed of light. A universally unsurpassable limit.

Smith, et. al. are trying to split hairs. Do "nuclear secrets" belong in Trump's home? Probably not. However, as President, he is granted immunity if he happened to have them. Then a review and negotiation should take place to return them. Smith is trying to make the argument for the extreme case and then apply it to everything, defying the Constitution and President authority. Instead, the correct view is to START with the Constitution and the ultimate power of the President. That CANNOT be overridden by the PRA, a simple law. If there is a conflict, the Constitution, and the President, WINS. Then if certain records are of concern or interest, there would be a RESPECTFUL discussion with the President to manage things to everyone's satisfaction. That is what has happened with numerous presidents. What is happening is the proof of a DOJ dedicated to lawfare with no consideration or respect for the law. Once Trump is President, there needs to be a MAJOR house cleaning at DOJ and in many other areas of the government and bureaucracy. Aegean Stables!
