The federal judge overseeing Donald Trump’s prosecution on charges of retaining classified documents agreed on Monday to expunge from the indictment a paragraph about an episode where the former president waved around a classified document at his Bedminster club in New Jersey. The US district judge Aileen Cannon ruled she would strike the paragraph because Trump was not charged with a crime for the conduct it described and would be unfairly prejudicial if a jury later saw it at trial.

What about the classified documents Biden had as VP? Legally, he was not entitled to them. And what about the documents stashed in his car trunk and in boxes in a shed?

Because the information was based a reporter's recording of Trump speaking. It could have been a newspaper he was "waving around" for all we know. The prosecution could prove nothing, other than use it to prejudice the jury.

Little by little justice is surfacing...President Trump was within his right as a President to hold the documents in a locked file...and nothing jack smith can say will change that....and the pictures of the documents on the floor in Mar-A-Largo was a set up by the FBI as directed by the washington swamp creatures.....

It's unusual for a judge to strike it from the indictment cause its unusual for persecuting attorney's to include such unconstitutional language. It's unusual because a non Obambi/Bide/Clinton judge in DC is on the case and is actually following the law, not their politics.

It used to be that you only discussed actually charged crimes in court. But obviously through recent Trump trials and charges in DC and NY courts, I suppose that has changed. Sarcasm key is now OFF.

afaik, the judge intends to investigate the doings of hack smith and cronies-and soon. she will be in a better position to assess dismissal after she separates the wheat from the gov't chaff.
