A low-profile case decided Wednesday by the Supreme Court could have big implications for employers’ diversity, equity, and inclusion programs. Muldrow v. City of St. Louis was a case about a female police officer who alleged that she was transferred from one department to another because of her sex. (Snip) A unanimous Supreme Court reversed, holding that any harm—whether significant or insignificant—satisfies Title VII.

Oh the Horror, oh the Humanity. How in this DIE world can this sensible DEI slap down occur???? Unanimous too.

One more example where our lazy-arsed Congress wrote a law which was open to bureaucrat/court interpretation and rule making. Do your job, people!

Maybe I read the article wrong (twice) but it looks to me like you now need no evidence of harm at all to win a DEI lawsuit. Thats a bad thing. Maybe one of our LDot legal types can double check me here.

One thing that was decided was to increase the legal fees that can be earned by lawyers filing future discrimination law suits by a country mile!

I think this is absolutely GREAT. The 14th amendment is very clear:
"...nor deny to any person within its jurisdiction the equal protection of the laws."
So, people MUST be treated equally. NO special treatment for race or sex. The leftists have been screaming about this forever....but it is NOT what they actually wanted they wanted racism and hate against whites and to a lesser degree asians.
Not OK. Now, STOP with the "equity" crap. The hard facts are that people have differing levels of initiative, intelligence and other things. RESULTS will vary if people are given identical opportunities.
And tough rocks if a lazy or stupid, or both person doesn't get as good an outcome as a hardworking or intelligent person.
I think the elimination of a requirement to show significant harm just wipes out the left's "Oh, we can descrimnate against whites" crap entirely. All that appears to be needed is "You treated me DIFFERENTLY because I am white" and the lawsuit can be filed and won.
GOOD. Treat people the same. Let the outcomes fall where they may. Equity be DAMNED. Equal opportunity. is the old and now, new again, phrase.

Maybe now we understand why so many companies were scaling back their DEI programs, and trying to call it something else won't relieve the potential damages they could incur.

This may bring back merit. If a person has a provable skill that another does not have, in a normal test, then that should be a valid reason for different treatment.
And the race baiters and the race grifters are going to be hysterical with anger at not getting special treatment for skin color.

Frankly, I think insignificance and immaterial should bear in all decisions. We cannot micromanage microaggressions, or any business will not be capable of operating.

I suggest the real point of the article and decision is that the standard for assessing harm or damage is so incredibly LOW, indeed, NON-EXISTENT that all attorneys have to do is file suits ALLEGING harm and watch the stampede of employers to the SETTLEMENT TABLE. This ruling is a Full Employment Bill for grievance attorneys.

I remember when I was working in a Government paid job the reason people were sent around from one place to another was because they were worthless and too hard to fire because they were black. Some were even given promotions just to get rid of them. This sounds like a loss to me.

Hear that distant rumbling growing louder and louder? It is a whole herd of rabid trial lawyers stampeding to feast on a new very lucrative DEI lawsuits bonanza against all employers and that includes the federal government and the woke corporations You listening Disney, Bank of America, Black Rock, Universities, etc., etc. Go get 'em sleaze bag attorneys and squeeze them until they howl in pain. Grab the popcorn, this is going to be fun.
