Appeals Court Sides With CNN Over Trump

Original Article

Posted By: earlybird, 11/19/2025 11:55:47 AM

A panel of appeals court judges on Nov. 18 upheld a ruling against President Donald Trump in a case he brought against CNN. Trump did not adequately show that CNN defamed him when it reported that he promoted what it described as the “Big Lie” when challenging results from the 2020 presidential election, judges on the U.S. Court of Appeals for the Eleventh Circuit concluded. Trump said that the phrase was intended to link him to Adolf Hitler and propaganda used by the Nazis in Germany, but the term is ambiguous enough to cast doubt on that allegation, according to the new ruling.

I'm fairly certain the Founders did not intend slander and libel to be included in the 1st A Freedom of The Press. The idea that because someone is a prominent public figure they can be slandered and libeled is BS. NO ONE is above the LAW ? The media certainly is.

Here CNN was clearly linking PDJT to der Fuehrer. Elsewhere they and their "progressive" media cohorts repeatedly declared that Trump IS Hitler. Through reckless deployment of their fallacious Reductio ad Hitleram strategy during his first term, they squandered all their remaining credibility (which I think was already so close to zero that they deserved to have no audience).

The Hitler quote is, "In the biggest of lies there is always a factor of believability." In German, from memory from before looking it up: "In der grosse des Luge liegt immer ein Faktor des geglaubtwerdens." [Later, after looking the actual German quote up: "In der Größe einer Lüge liegt immer ein gewisser Faktor des Geglaubtwerdens." Not bad from memory and high school German class 40 years ago.] The only place the phrase "Big Lie" is used in popular culture is in the James Bond novel "You Only Live Twice," where Bond is on the radio to an air traffic controller and tells him he is the one who cleared him to fly through the territory. Bond also a tributes the phrase to Hitler. So we are left with two things. One, it isn't a lie at all. And the reference to Big Lie is a reference to Hitler. Mark Stein has been sued for over 10 years for calling a scientist a "fraud." Calling someone a liar and comparing them to Hitler is defamation by definition.

CNN's ratings being in the toilet still provides a victory for Trump and the rest of us. He still holds the power to ban them from the White House and Air Force One. He should use it.

A bicameral group of Republicans in Congress is grilling James Boasberg, the U.S. district chief judge for Washington, D.C., on his decision to allow lawfare activist Jack Smith to spy on the Senate, offering him the “opportunity to explain yourself publicly” for a decision that almost certainly violated federal law. As The Federalist reported, Boasberg approved a scheme under the Department of Justice’s Arctic Frost weaponization against Republicans in which Smith could subpoena the phone records of House and Senate Republicans and attach a nondisclosure order (NDO) so that the congressional bodies could not find out about it from the telecommunications providers being subpoenaed.

Pennsylvania will lose $75 million in federal roads funds unless it gets into compliance with U.S. Department of Transportation (DOT) licensing requirements for non-domiciled commercial learner’s permits (CLP) and non-domiciled commercial driver’s licenses (CDL). That is according to an alarming letter DOT sent Wednesday to Pennsylvania Department of Transportation (PennDOT) Secretary Mike Carroll and Gov. Josh Shapiro. The threatened loss of funding comes on the heels of the recent Kansas arrest of an illegal alien wanted in Uzbekistan for belonging to a terrorist organization, according to ICE. As The Federalist previously reported, the alleged terrorist Akhror Bozorov was issued a non-domiciled CDL in Pennsylvania.

When Europe goes to war with Russia, they will not require the military to fill out customs declarations as they cross borders within the EU. Tanks, missiles, artillery and most combat weapons could be exempt from EU customs declarations if the plan by Brussels moves forwardAdditionally, under the proposal most drivers of military equipment may even be permitted to exceed the limits on driving times and rest periods, should the fight against Russia require extended physical effort. The newly proposed objective is to empower European soldiers to make independent decisions without having to fill out the customary paperwork, requiring prior approval from the European Commission before affixing their bayonets.

ALEXANDRIA, Va.—The Justice Department said in court on Nov. 19 that the full grand jury in former FBI Director James Comey’s case never saw the final indictment used to charge him, an issue Comey’s attorney described as fatal to the prosecution. The revelation was made amid scrutiny of the grand jury proceedings, but this particular hearing was focused on Comey’s argument that the prosecution should be dismissed as vindictive and unconstitutional. After some argument about the motion, Judge Michael Nachmanoff of the U.S. District Court for the Eastern District of Virginia asked Justice Department attorney Tyler Lemons for further details about the indictment.

The Trump administration has done an admirable job of stopping border crossings by illegals since taking control of the executive branch in January, but as many Americans who voted for President Donald Trump know, stopping those people is only half the battle. The other half is efficient and effective mass deportations to the tune of 1 million per monthThe Department of Homeland Security (DHS) announced in late October that more than 2 million illegals had left the country, most of whom self-deported, while DHS forcibly removed 500,000. DHS spokeswoman Tricia McLaughlin said the Trump administration was on pace to deport 600,000 by the end of Trump’s first year back in office.

Fake news was working overtime on Monday by declaring, without authority, that the “full, complete” presidential pardons related to the 2020 presidential election cannot protect against bogus state charges arising from that election. Corporate media wrongly insisted that the pardon clause in the U.S. Constitution applies only to charges brought by federal prosecutors. Not so. The pardon clause states that the president “shall have Power to grant Reprieves and Pardons for Offences against the United States, except in Cases of Impeachment.” Every attempt in court to narrow the scope of the pardon clause has failed.

Republicans are at odds over an effort to unwind a controversial provision tucked into the bill to reopen the government that would allow senators to sue for substantial sums if they aren’t notified when federal law enforcement seeks their phone records. The provision has fueled classic tensions between the House and the Senate, prompted an effort to repeal the new law, divided Republicans, and started to become fodder for primary opponents. Signed into law by President Trump last week, the unusual addition to the spending bill fundamentally changes how investigators must treat the 100 members of the Senate.

Indiana’s attorney general took two major enforcement actions this week targeting potential migrant trafficking. His office declined to disclose the subpoena contents beyond mentioning business, financial, and client records and relationships, saying confidentiality is legally required because subpoenas do not accuse recipients of wrongdoing but solely seek information.

Since 2022, voters have been divided about which party’s candidate they would support.” This, even though those polled “place most of the blame for the shutdown on congressional Democrats.” Still, “six in ten [blame] either the President or the GOP in Congress.”

The SNAP scrutiny kicked off earlier this year when Health and Human Services Secretary Robert F.
