McAfee Splits the Fani Baby?

Profiles in Courage, it ain't. (snip) So, if I have this right, Fulton County Judge Scott McAfee decided to pull a James Comey, Robert Mueller, and Robert Hur:
Write a ruling saying Fani Willis and Nathan Wade are guilty as hell, have no ethics, and aren't good role models....BUT Fani can stay (snip) The problem with splitting the baby is that the baby dies. That seems to be what happened here in McAfee's attempt to be Solomonic. If he wanted Fani Willis to remain in charge of the case, he needed to exonerate her from all of these issues.

I am not a lawyer or a judge but he should have cut them both loose. The stink emanating from these two is overwhelming. As far as I am concerned the moment she perjured herself was enough to kick her to the curb. If they do not follow the rules, but expect others to, then they need to find a new line of work.

This judge is corrupt. If you read his ruling, it is more convoluted in reasoning that Justice Roberts Obamacare reasoning. He dismisses Fani's perjury as nothing. This judge and his ruling are just another nail in the coffin of our judicial system.

What a judicial precedent: Identify the criminal's dirty deeds, then let the criminal decide if they should go to jail.

McAfee didn't split anything. He basically said that appearance of blackness now supersedes appearance of impropriety. These two grifters committed numerous crimes, and shoved them in his face. They visited the WH, yet Trump's due process was not violated? Seriously?
McAfee is a coward who is saying that if you are a Democrat out to get Trump, you get a verdict of "no consequences" for illegal activity. Fulton County is beneath pathetic.

Yeah, Mr Morrisey has it correct. Da Judge didn't want to upset the voters prior to the election, so he issued a ruling that would insure that the defendants would appeal the "baby cut in half" decision so he could wash his hands of it.
I figured when he dismissed the extremely weak charges this week (as opposed to the remaining just weak charges) that he was going to find a way to save Fani's fanny.
Wonder where Fani and Wade will be going this weekend? Oh yeah, and remind Fani to bring cash.

There was no way to exonerate the corrupt and nasty home wrecker so he just said what she did was ok if she just fires her stud now and doesn't pay him for his gigolo services any longer.

So - the judge wanted to be Solomon, but instead became Pontius Pilate. He reminds me of that old joke:

An attorney once told me, don’t look to litigation and the courts for justice. Courts are about resolving disputes, not about seeking truth, justice and the American way. So splitting the baby is routine.

Since this Democrat Judge who has reportedly contributed money to Fani in the past, is apparently running for reelection to his Judgeship, if he wants to win his reelection attempt, he had to issue a decision that he thinks will help his fellow Democrats, and no way was going to issue any decision that diminishes any aspect of Black culture surrounding the aspects of the obvious conflict of interest shared between Fani and her paramour Nathan.

I heard the judge at one time worked under fanny-tail. What happened to recusals in cases like this? My bad; rules and laws don't apply to them. They do what they want.

Rejoice. The court provided a gift to the defense by preserving a federal question that is now appealable to the Supreme Court. The court stated at page 22: "Defendant Latham asserts a claim accurately categorized as one of selective prosecution, and the United States Supreme Court has recognized that such claims are not a defense on the merits to any criminal charges themselves. United States v. Armstrong, 517 U.S. 456, 463 (1996). Instead, a claim of selective prosecution must be brought in the form of a motion asking the trial court to exercise its judicial power on equal protection grounds. Id. at 464- 65. Lacking such a showing here, or any foundation in law or the rules of evidence, the motion is denied." Selective prosecution is not a defense. It is a bar to prosecution. Whether the defense should raise it by separate motion, have it denied, and then go to federal court, is an obvious roadmap at the very least to getting it to the Supreme Court. If not raised in the trial court, it is not appealable.
