It’s safe to say that Chief Justice John Roberts would rather keep the U.S. Supreme Court out of the legal battles that seem destined to define the 2024 presidential election. Unfortunately for Roberts, it will be all but impossible for the Court to avoid deciding whether state officials and courts possess the legal authority to remove Donald Trump from primary ballots after declaring him guilty of a crime for which he has never been charged. Because SCOTUS is likely to rule in favor of Trump, it will produce outrage on the left and countless comparisons to Bush v. Gore.

Bush v Gore was nothing like the Trump situation at all. He should be on the ballot in each state. Violating his due process rights by "declaring" him guilty of insurrection and violating the voter's rights to cast ballots for their party's candidate of whomever meets the Constitutional requirements to run, is no way to run a "democracy." A totalitarian government may be efficient, but it is never good.

I don't see how the Supremes can turn down this case. It opens the door to candidates being thrown off the ballot on a political whim. At a minimum, I see the court ruling on whether or not the 14 amendment applies to Trump.

Good article. But let me sum it up: the Dems/ Communists can never win in the arena of ideas. Hence, the need for articles like this to summarize and articulate the pseudo legal machinations they will employ to win. And as Mr Catron summed up at the end: “ The republic won’t survive if SCOTUS blows this call.”

Election theft and systematic disenfranchisement is criminal activity of the highest order. If the SCOTUS wants to stay away then it's very existence has no meaning.

The SCOTUS should rule on the law and what is Constitutional and right and not be political in any way. Unfortunately that is not the present situation.

Neither Bush was great shakes as president, but W did the Nation and the world an immense service by beating the appalling Gore and causing the inveterate liar to go clinically insane. Ever since December '00 Gore has regularly made a growling spectacle of himself with his predictions on the climate that have always been 100% wrong. This LDotter was happy to be one of the 537 Florida votes that Bush won by. Gore, to his eternal discredit, was the first person to try to sue his way into the presidency. For that alone (and for a lot of other things), he'll burn in hell.

I am inclined to think that SCOTUS will rule on the intent of the law and the validity of it's application at the state level. Unfortunately the Constitution invests the individual states with the power to set their own election rules, not the FedGov. As long as the states do not make rules that exclude any political, racial, or other general categorization of it's citizens they are free to proceed. I am not sure that the exclusion of a single name on a ballot qualifies as an illegal thing. The exclusion of PDJT's name on the ballot in blue states is ridiculous. It shows clearly how the left cannot win votes with their ideas hence the lawfare being invoked.

Unless it is stopped, there will be a day when Amerika burns the Constitution and drafts a new "constitution" that places selection of Amerika's dictators into the hands of a Washington politburo while us debt-slaves live out our miserable lives.

Forget the legalistic rhetoric and even forget interpreting the Constitution. Let's get down to basic, simple-to-understand, "Innocent until proven guilty." Any human standing on American soil can, and does, understand that. This includes the illegal aliens present from all the many differing foreign governments. (In fact, it is one of the reasons the "asylum seekers" are seeking asylum here.) Not only has Trump not been proven guilty, he hasn't even been formally charged with the "crime". If the Chief Justice of the Supreme Court of the United States of America can't see how to rule on this, Biden isn't they only one that needs to be removed from office for incompetency.

Florida 2000 Presidential election: These numbers are pretty close. 5.6 million votes cast First count Bush by 1760 votes Second count Bush by 1100 Official count 6 months later 537 for Bush 1) Paper ballots not designed for the machines. 2) media calls Gore before the pan handle (total bush country) closes, due to to time zones. 3) democrats try everything to steal this, changed election laws after the vote, Supreme Court etc and don’t succeed. Happy Friday, dear Kruiser Morning Briefing friends. Yerzenwul felt that it was almost time to share his love of hamster haiku with everyone in Omelette Appreciation Club. It has been a whirlwind few days since the Colorado Supreme Court took a plunge off of the progressive cliff and booted Donald Trump from the state's GOP primary ballot. In the first 24 hours or so after the ruling, reaction predictably broke along party lines. The rabid, Trump-hating Left was ecstatic, of course. Even Republicans who aren't Trump fans thought the court had severely exceeded its authority. Everyone immediately became a legal expert and opinions were flying like Frisbees at the beach.

Despite being in bad shape politically, President Joe Biden has not hit rock bottom yet. Unlike in 2020, Biden is going to have to campaign, and he is going to have a record to defend — his alone, not one he inherited from former President Barack Obama. And unlike in 2020 and throughout his presidency, the establishment media will have to cover him. As history has shown, exposure and coverage are not a good combination for Biden.
