Federal courts of appeals cannot agree whether climate change lawsuits are governed by state or federal law. Some federal courts have also concluded these cases should proceed in state court, an outcome Judge David Stras – a respected jurist on the U.S. Court of Appeals for the 8th Circuit – just last week called "confounding," even if correct. It’s time for the Supreme Court to intervene. For over a century, the Supreme Court has held that lawsuits over air (and water) pollution that crosses state lines must be decided under federal law. This means overreaching states and cities cannot impose their environmental agendas on their neighbors

These lawsuits should primarily be governed by true science and honesty. Which they are not. The political agenda of Climatistas has nothing to do with clean water, air and well managed land resources. it is a Trojan horse for the Left to get what the voters would not give them at the ballot box. Which category of courts is least of the problems.

The start of the movement of all governing decisions and actions began with FDR and Social Security where everyone was promised and believed that for just a few pennies per pay check you could have a secure retirement. It was sharply increased with LBJ's Great Society programs where for just a few pennies per pay check you could enjoy almost 'free' health care. Creating the GI Bill of Rights began the idea that government's role included 'educating' the citizens and therefore we needed a Department of Education. Throw in a department to oversee all air, land, and water really grabs a lot of power. All these actions greatly increase the number of 'government' employees needed to write rules, oversee, and enforce the actions. The politicians know that by promising and giving salaries, benefits, perks, and other advantages over the taxpaying serfs they can be more easily reelected and stuff their own pockets. Somebody or something needs to destroy the swamp so that governing can return to near proximity to those affected. The closer the government the better the government.

That is a double edged sword, states imposing regulations that effect neighboring states as opposed to the federal government affecting all states. It is a states rights verses federal government rights issue. It is like the current wacked out woke administration stopping oil pipelines and drilling.

Follow the money and it will lead to elites who believe they should rule the world. This movement is all about intimidation, greed, and an insatiable power to control. However, it would have never gotten off the ground without the world’s willingness to believe the absurd. Even the smartest among us dared not oppose them. It’s very difficult to stand when the majority of the scientific community quickly fold under peer pressure or more likely submit to protect their funding. The movement is vicious, very well funded and brooks no dissent. Plus, they can count on the media and entertainment industry to follow their lead like lapdogs. Academia abandoned all scientific peer review because they were cowards. It was easier to go along to get along and more lucrative. So, here we are destroying our economies for a pipe dream created by the same people who are desperate to rule over the rest of us. This is their strategy. They love to drum up fear because they know if you can make a people fear, you can control them and that is the ultimate goal. Their goal is a cowed population easily led who are living by rules that the climate elites create but refuse to follow. It is mental slavery and will quickly devolve into the real thing because the elites believe we are less than and that gives them the right to rule over us, and they will. Slavery never dies, the evil among us just tweak it and repackage it. We will be slaves to the globalist agenda. Their leaders tell us we will own nothing and be happy. If this becomes reality, freedom and God given rights will be abolished and we will become wards of the state. The climate will not improve but their power will exponentially explode.

As tools go, a battering ram is neither sharp nor precise. But it can do tremendous damage. The Vegetable is such a tool; dull but destructive. But more dangerous are those wielding said ram: obama, POSoros, Klo Schwamm, the red shields and the like. They are thieves not just of money...but of Liberty, Peace and civilized society. #5 regarding kalifornika's air pollution laws affecting all products which transit that state (of insanity), I contacted both of my Senators regarding that national taxation without representation last summer. Neither Cruz nor Cornyn replied.

I thought States Rights were gone, given the 10th Amendment to our Constitution is totally IGNORED!

We'll have to see what SCOTUS does. Since Scalia was removed, and the order to not protect the Justices from 'protestors' became the reality, there's no tellin' where this might end up.
I think the true 'leaders' of the world have front run the situation so they win no matter what happens. While it looks like a redistribution is occurring its merely a transfer. 'Meet the new boss ...

let's stop the confusion: that which is not allowed by the Constitution to be governed by the feds--belongs to the states.
health education and welfare belong to the states: the environment encompasses all 3.
