BOSTON — A federal appeals court in Boston ruled on Friday that the Trump administration cannot withhold citizenship from children born to people in the country illegally or temporarily, adding to the mounting legal setbacks for the president’s birthright order.
A three-judge panel of the 1st U.S. Circuit Court of Appeals became the fifth federal court since June to either issue or uphold orders blocking the president’s birthright order. The court concluded that the plaintiffs are likely to succeed on their claims that the children described in the order are entitled to birthright citizenship under the Citizenship Clause of the 14th Amendment.

the 1st district appeals is the smallest as far as number of judges, only six, seat three is currently vacant with an appointment by Trump being held up in confirmation...of the remaining five judges? 4 were appointed by Biden, one by Obama. Retired SC justice Breyer occasional sits in on cases as well...as did Souder before him. Which three made this ruling? Does it even have any bearing at all on cases outside of their district, made up of Maine, Massachusetts, Rhode Island, New Hampshire, and Puerto Rico?

Yes it can. An accident of birth does not entitle illegal aliens' citizenship. Sometimes it's no accident, they come here in the eighth month of pregnancy just for that purpose.

This is a tricky question. Do we interpret the Constitution according to today's standards as the Dems want or do we interpret it as how we thought the founders thought? In this case it's hard to believe that the founders considered a foreigner traveling to America just to give birth here.

A deliberate misinterpretation of the Fourteenth Amendment - it's language as well as basic intentions by a liberal judge has resulted in this mess. Just like Roe v Wade, time for the SCOTUS to step in and set things right.

This statement is supposed to make us believe it must be really illegal since five federal courts upheld it. So, let me fix it, so the truth is reflected:

#9, Original Intent only, even though the case is often made by libs/socialists that many of the founders were slave owners so by their definition of acceptable their views must be disallowed for consideration.

Read the Fourteenth Amendment, Section 1:
All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside.
Illegals are NOT Citizens, but they ARE subject to the jurisdiction thereof, and that Jurisdiction is their mother country NOT the United States.
I have to assume these Judges can not READ!

Birthright citizenship for children of illegals belongs in the dustbin of history right alongside Roe vs Wade. No other country in the entire world does this. Only politicians who with no plan for the future would be in favor of it...like the Dems. They have finally been exposed as the party of Traitors. The definitive answer has always been a Constitutional Amendment, which is the same answer to the democrat's never-ending quest to push laws to effectively negate the second Amendment. Two-thirds vote in the House and Senate and three fourths of the states vote to ratify, then the matter is settled.

ireland and other countries have ended birthright citizenship.
here's the scary part:
we have herds of foreign scientists in this country who claim dual-citizenship.
they can actually live here or abroad in friendly-or unfriendly- countries -- and not lose their posh jobs.
in our state, govt, corp, academic, espionage is a cottage industry.
