Following U.S. District Judge Aileen Cannon's decision to dismiss the classified documents case against former President Donald Trump, Special counsel Jack Smith said he intends to file an appeal.
"The dismissal of the case deviates from the uniform conclusion of all previous courts to have considered the issue that the Attorney General is statutorily authorized to appoint a Special Counsel. The Justice Department has authorized the Special Counsel to appeal the court’s order," Peter Carr, Public Information Jack Smith's office told Fox News Digital.

So, an unconstitutional "special counsel" is being given the "okay" by the DOJ who set up the unconstitutional "special counsel" to appeal the Federal Judges decision.
Presume they may find some other judge who doesn't bother reading, or understanding, the Constitutional process just like the other judges who they mention not finding any problem.
However, this issue was mentioned by SCOTUS in the recent opinion rendered on Presidential Immunity by Justice Thomas, so it's likely a much higher bar now.
They just can't see how they've lost so many cases and opinions when they thought they had it all in the bag from the get-go.

Common sense will tell you that as it stands tonight, that Jack will end up being fired by Trump’s new Attorney General and the case withdrawn before the Supreme Count renders a decision, that is if the matter even gets to the Supreme Court.

He is just a citizen. Does he even have standing to appeal? To represent the federal government in the appeal? Seems to me that all his fees should be forfeited. And win or lose on appeal, if it goes to the supremes, a decision there would be binding across the country, to other current hi profile cases, and then retroactively to prior improperly prosecuted precedents. Heckova risk.imho, for the justice department to take, especially considering that the people will speak on this case in November.

If the DOJ was not authorized constitutionally to appoint a Special Counsel in the first place, how can it authorize that unauthorized Special Counsel to appeal any decision? The Special Counsel has no authority and doesn't legally exist. If anyone is to appeal the appointment, it would have to be Garland himself. Seems to me.

He will appeal because he has no other choice. He knows that he is beaten, but his political masters expect him to continue the fight against Trump. In my opinion, Judge Canon went easy on him. She could have charged with a number of crimes, including obstruction of justice.
