The Supreme Court is set to consider if Donald Trump should be banned from running for president and whether his name can be left off the 2024 ballot in Colorado.
Trump was declared ineligible to appear on the Colorado ballot on December 19 and his appeal against the state's Supreme Court's decision will be heard on Thursday.
The decision marked the first time in history that Section 3 of the 14th Amendment has been used to disqualify a presidential candidate. The Civil War-era rule states that people who participate in an insurrection are ineligible for office.

I wish I had confidence that SCOTUS would do the right thing but I do not. I shake my head and wonder, when did everything regarding the judiciary go so wrong? The system is broken. Lady Justice not only discarded her blindfold, she willingly puts politics before the Constitution. We cannot survive this.

The wording of Sec 3 is quite clear. "...having taken oath previously as an officer of the United States". The Constitution defines an officer as a person appointed by the President. It is obvious that Art 14, Sec 3 does not apply to former or serving President and Vice President. This is law 101.

The silly thing is the vast majority of Americans believe the Judiciary, somehow, is legitimate. We believe we can get a fair trail and judges will follow the law. Nothing has been further from the truth! Read the 'plain English' is joke. If judges did that we would never had Roe v. Wade. All the law fare against Trump has been based on radical far left, twisted applications of tangential laws. And thus far, every crack pot black robe appointed legislature has rule for lawfare. Now we have courts that actually want to do away with the juries, due process and the right to confront our accusers and just let leftist judges do all that. Amoung the many issue that need to be addressed with a Convention of States, reigning in the out of control, democrat loving judiciary. And as long as we hold dear the fairy tale that the Judiciary is legitimate, the worse thins will get.

There was no insurrection. I watched this on TV til Trump told everyone to leave peacefully and go home. It was a peaceful crowd. The only crime committed was a capitol cop shooting and killing Ashleigh Babbitt. He was rewarded for that by a promotion and raise.

Perhaps the Supreme Court will also remember how they felt, shortly after the "Roe v. Wade" overturn, as Joe Biden failed to enforce laws designed to protect Justices from mad mobs as his AG, Merrick Garland allowed angry protestors to assemble in the street where several Justices lived, even allowing a boy from COLORADO to knock on the door with the intent and capability of murder. Colorado, yes, THAT bastion of liberal insanity.

#3 is correct. This will set the tone and a precedent for the coming "election".
That's all they need. If Trump is off the ballot, it's over. Leftist rule from here on.

When a 'mob' stormed the Capitol, was all I needed to read, to know it was a BS Daily Mail article. After Talib 'stormed' the Capitol with her mob of insurrectionists, has she been ruled ineligible to run for government office? She was physically on site, unlike PDT. Of course, she's a dimwit, so she's covered by the two-tiered just us system.

If insurrection is defined as forceful overthrow of a legitimate government then why not charge FJB and his cabinet with insurrection for deliberately not executing legitimately passed and enacted code re: immigration/invasion, destruction of government property during the George Floyd riots, failure to protect justices after Roe, failure to investigate irregularities in the 2020 election process, etc.
Who has standing if not every citizen?

"No person shall be a Senator or Representative in Congress, or elector of President and Vice-President, or hold any office, civil or military, under the United States, or under any State, who, having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any State legislature, or as an executive or judicial officer of any State, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof. But Congress may by a vote of two-thirds of each House, remove such disability."
Just a reminder that Cackles Magee gave aid and comfort to the insurrectionists who torched the Minneapolis 3rd precinct and laid seige to a federal courthouse when she raised funds for bail for them. Just sayin'.

If they rule January sixth an insurrection, the only path left is rebellion. Trump or no Trump. America must be free under just Laws and the Constitution.
