Former President Donald Trump unveiled a new policy pledge on Tuesday morning, saying he would immediately end birthright citizenship for illegal immigrants by signing an executive order if he wins the 2024 presidential election. 'As part of my plan to secure the border, on day one of my new term in office I will sign an executive order making clear to federal agencies that under the correct interpretation of the law going forward the future children of illegal aliens will not receive automatic U.S. citizenship,' he said in his latest policy video. The idea was floated repeatedly during Trump's time in office.

He can try, but it will be hard to get around the 14th Amendment, in particular, “All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside.”

At a minimum it will take congressional action. Then whatever congress passes will have to survive in the courts. The 14th Amendment provides: “All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside.” The only issue is what is the meaning of the qualifier "... and subject to the jurisdiction thereof ..." Those arguing that birthright citizenship is automatic to anyone who is born in the US, even if both parents were here illegally, ignore "and subject to the jurisdiction thereof" completely.

Sometime ago I read that the interpretation of the 14th Amendment which allows birthright citizenship for noncitizen parents is based on a one-line footnote in a US Supreme Court opinion. As is so often the case in law, the context of the meaning of one sentence can affect its interpretation. The 14th Amendment was intended to prevent Dimocrats from denying citizenship to former slaves, not to give citizenship to offspring of pregnant tourists. But, it was a long time ago that I read the article. I can't help but wonder why Trump didn't do this during his first term. And what it would take to do it? A supreme court opinion? An act of Congress? A constitutional amendment? Is there a public opinion now that there wasn't in 2016-2020? Will all the Dim's false accusations now fail to prevent public outcry against Trump? A sort of corollary to the "Boy Who Cried Wolf" principle? Is it too late? Have the Dims destroyed the cultural infrastructure necessary for modern civilization?

I argue that an illegal alien is not under us jurisdiction. A legal immigrant is. That sticky issue would end up at SCOTUS.

IIRC the clause "subject to the jurisdiction thereof, are citizens" exempts the children of foreign officials such as Diplomats. I avoids putting such officials in an awkward position with their own government. The clause would probably still be interpreted that way by the courts. If so it can't stop anchor babies.

#4. Not hard at all. The provision has repeatedly been interpreted to apply to children born of citizens or permanent ( i.e. a green card holder). Illegals and tourists do not fall under its preview, unless Congress says so. Currently, the law is not clear and an executive order might suffice. A law certainly would prevent this.
