President Biden trial court nominee Kato Crews was stumped by questioning from Sen. John Kennedy, R-La., during confirmation hearing testimony on Wednesday. Crews, a nominee for district judge of the U.S. District Court of Colorado, was asked by Kennedy how he would "analyze a Brady motion," with Crews answering that he had not "had the occasion to address a Brady motion" during his four and a half years on the bench.
After stumbling over the answer, Kennedy asked Crews if he knew "what a Brady motion is." Crews, who currently serves as a magistrate judge, admitted that the concept was "not coming to mind"

The nominee for judge is BLACK. He doesn't need to know anything about THE LAW. He is DIVERSE!

I love Kennedy, but this one was a tad unfair. Federal magistrate judges are court employees appointed by the "Article III judges," who have been appointed by the president and confirmed by the Senate. Magistrates have limited criminal jurisdiction to handle misdemeanors, and preliminary matters in felony cases, e.g. bail, first appearances, motions to suppress evidence, extradition motions, etc. Defense attorneys generally bring a Brady motion to produce exculpatory evidence later in the case, when they believe that prosecutors are withholding such information. Not surprised by Judge Crews' answer.

The man is old enough that when he attended law school, most were still teaching law. Affirmative action probably gave him the day off to sleep when the Brady concept was being taught

Excuse the second post. Prior to becoming a magistrate judge, Crews practice employment law and civil litigation. It is true that Brady v. Maryland is covered in the class called Criminal Procedure, but so are a ton of other motions that by name (but generally not constitutional substance) are long forgotten by civil practitioners.

Responding to #3 (and 6): the question was not inside baseball, it was not unfair in the least. I was a workers’ compensation judge and my practice prior to becoming a workers’ comp judge was almost exclusively workers’ comp. I know what a Brady motion is. And, it being the job of the prosecution to seek justice, not convictions, I know that the prosecution has a legal and ethical responsibility to produce all even potentially exculpatory evidence to the defense, Judge Crews, not having a clue, would fit right in with the judges now depriving the J6 defendants (like the Shaman) of their Constitutional right to exculpatory evidence. Not acceptable.

I have never posted three comments, but I am doing so now in light of those who have assumed Judge Crews is a mediocre nominee. First, we are not acquainted. Judge Crews was Law Review at the University of Arizona, which admits fewer than 10% of its applicants. This year’s entering Arizona 1Ls had a median undergraduate GPA of 3.75 and a median LSAT of 163. Crews graduated near the top of his law school class. Enough said.

Can you take the Oath of Office without any mental or emotional reservations, or any other kind, in order to able to swear to uphold and defend the Constitution of the United States of America? If you swear falsely you are disqualified and can be prosecuted for perjury. (Or ought to be.)

There is a very good reason why the nominees from this dumpster fire of an Administration, judicial and otherwise, do not deserve the benefit of the doubt. Almost without exception, they are unprepared, unqualified morons, whether Affirmative Action-propelled or not, as any observer of their Senate confirmation hearings can clearly see. Maybe this clown is one of the rare exceptions, maybe not (and I know which way I'm betting). But benefit of the doubt? No way.

Kennedy asked this man about many decisions he had made that had been reversed.
When a Judge's decision is reversed that mean he made a wrong decision.
This man appeared to have made the wrong decision a lot of times.

Maybe this person is not qualified enough to be on the bench for the position.
And, maybe this is more telling of some "Article III judges" and who they employ as a Federal magistrate.
Could explain a lot, and maybe even by design in some jurisdictions.

Can't anyone see the pattern here? The Biden administration consists entirely of no-show incompetents who can squeak through a rehearsed confirmation process. This is purposeful so the actual decision-makers don't have to go through a confirmation that would certainly eliminate them. The no-shows are given written statements to read when necessary, but otherwise take vacations on the taxpayer dime and let the shadow government run their departments. This includes Biden himself.

For those defending this judge, he may be qualified for the position he is IN, but that's not the question. Without a basic knowledge of the Constitution he is UNQUALIFIED for the position Biden wants to put him in.

I was a civil lawyer, but I know what a Brady motion is. He didn’t even know that. I have seen first hand what happens when people not smart enough for the profession are affirmative-actioned into the job. Putting them on the bench is unconscionable. We are dragging professional standards down to Third World levels.

Senator Kenndy with his aw-shucks demeanor and his accent makes the leftist democrat forget that he has a sharp mind and a get to the "meat of the subject" attitude. To watch him skewer diversity hire goofballs like Kato Crews is a thing of masterful beauty. This is par for the course for the FJB regime. Put forth diversity, equity and inclusion affirmative action hires. Then when they get questioned by Senators like Kennedy, they're called racist by the democrat propagandists posing as the MSM. The problem with that is Senator Kennedy makes them look like the fools they are.
