The vax opinion I want

Original Article

I am not a lawyer and I skipped listening to the arguments over the vax mandate because the mandates are patently unconstitutional. (snip) The court will render a decision in a few weeks that will disappoint true Americans by giving the mandate argument credence. In fact, I suspect the Roberts Court will uphold the mandate by tying it to the congressional power of taxation or the good old interstate commerce clause, which justices created a century ago to allow the federal government to do whatever the hell it wants.(snip)Here is the decision I want: No. How about just plain no?

Plus some other stronger versions of No.

I have zero confidence in our “conservative” court! President Trump! What the heck happened with Amy (hyphenated last name)? Another loser! Do conservative judges even exist anymore? Trump blew it big time with a chance to swing the court right for years!

Surber is right (as usual). The arguments seemed to focus more on whether forcing people to get the Covid vaccine was a good thig or not. Whether it is or isn't was not the question before the court and the liberal justices to let emotions guide their questions, not the potential laws or Constitution. The questions before the Supreme Curt last Friday was are the mandates constitutional, period! Whether good or bad, if they are unconstitutional, they should not be forced upon people. The law is supposed to be free of emotion. Some of the justices have forgotten this.

Surber has never been more spot on. The government exists to protect our rights as charterd in the Constitution, not ensure our good health.

Don is not going to get anything close to the opinion he wants. During the oral arguments the Constitution was hardly mentioned other than tangentially, It's highly unlikely the Court's opinion will be based on the Constitution as whenever possible the Court avoids making a decision based on Constiutional grounds. During oral argument there were references to a long list of federal statutes that already authorize the federal government to mandate vaccines in a wide varitry of contexts. Anyone who has served in the U.S. military knows that mandating vaccines is common. The Court will most probably NOT uphold the OSHA mandate. The 5th Circuit Court of Appeals opinion, which struck down the OSHA mandate, was far more persuasive than the 6th Circuit's opinion.

You may have heard of the protests in Tbilisi, Georgia recently. The protests are framed around what the State Dept and CIA call “Russian favored” legislation. The Georgia legislation essentially says that domestic lobbyists, NGO’s, entities, groups and individuals who are funded more than 20% by foreign interests need to register as such. Essentially, the USA law we call the Foreign Agent Registration Act (FARA), is what the country of Georgia is enacting in their own political landscape. However, the USA is not happy about the Georgia law to disclose the source of foreign funding

Justice Sonia Sotomayor used Thursday’s Supreme Court hearing of Donald Trump’s presidential immunity claims to further Democrats’ debunked “fake electors” narrative.(snip) “What is plausible about the president insisting and creating a fraudulent slate of electoral candidates?” Sotomayor asked. “Assuming you accept the facts of the complaint on their face, is that plausible that that would be within his right to do?” “Absolutely, your honor,” Sauer argued, citing President Ulysses S. Grant “sending federal troops to Louisiana and Mississippi in 1876 to make sure that the Republican electors got certified in those two cases, which delivered the election to Rutherford B. Hayes.

U.S. Supreme Court Justice Clarence Thomas has asked former President Donald Trump’s lawyers about whether they challenged special counsel Jack Smith’s authority to bring charges against the president. (snip)Justice Thomas asked John Sauer, the attorney who represented Trump in court, “Did you, in this litigation, challenge the appointment of special counsel?” Mr. Smith was appointed to the case by Attorney General Merrick Garland. Mr. Sauer said that Trump attorneys have not raised such concerns “directly” in the current case at the Supreme Court. However, “it points to a very important issue here, because one of [the prosecution’s] arguments is, of course, that we should have this presumption of regularity,” Sauer stated.

The Associated Press (AP) admitted Friday that this week’s indictment of 18 Arizona Republicans is “part of a campaign” to “deter” Republicans from raising challenges and concerns about the integrity of the 2024 election. Democratic Arizona Attorney General Kris Mayes indicted 18 individuals, 11 of whom she claims acted illegally when they convened as alternate electors to certify the Arizona election in favor of Donald Trump while challenges to the tight election’s initial results were ongoing. Under the headline “Charges against Trump’s 2020 ‘fake electors’ are expected to deter a repeat this year,” AP’s Nicholas Riccardi wrote the indictment of 18 people “could help shape the landscape of challenges

A major witness in former President Donald Trump’s so-called “hush-money” trial admitted to inconsistencies in his previous testimony and suggested that a related FBI report “could be wrong.” Former National Enquirer publisher David P*cker, who has testified in the case this week, was questioned by Trump attorney Emil Bove about statements he made to federal prosecutors in 2018 that the defense lawyer said were “inconsistent” with the former publisher’s testimony earlier this week. The Trump team pointed out discrepancy between Mr. P*cker’s testimony this week and 2018 FBI interview. This week, the witness testified President Trump thanked him for handling two stories in a 2017 meeting at the Trump Tower.
