The Supreme Court ruled by a 5-4 vote to keep Title 42 in place just hours ahead of its planned midnight Wednesday end.
The Covid-era public health policy that allows border agents to immediately expel migrants will now remain in place until legal battles involving its end play out in court.
Agents will now be able to use the policy to expel border crossers for at least the next several months, leaving an onslaught of migrants who were expected to rush the U.S.-Mexico border after Title 42 was lifted in limbo.

I believe Gorsuch used conservative logic, applying the separation of powers doctrine to indicate that it isn't up to the Supreme Court to make policy. For many years, liberal SC justices did just the opposite and we conservatives were decidedly unhappy about their forays into policy making. As a Texan-American, I detest what Biden, the DC democrats, and media are allowing at our southern border but the Supreme Court is right to stick to deciding cases based on the law and not overly intruding into the legislative or executive branches of our central government. My biggest disappointment is with the American people who are not of the socialist/communist persuasion. We have been the most do-nothing generation of Americans in our history. Most people look to their politicians, even when politicians are the problem, to avoid troubling themselves to take demonstrative actions. The J6 circus has had the effect of further cowing an already timid group who view themselves as patriots. Crying "RINO" has replaced demonstrative action as a national expression of displeasure.

Chances are the tens of thousands of prospective illegal aliens from many countries who have been sojourning on the Mexican side of the borderline awaiting for Title 42 to be abolished are not not going to turn around and hike back to their home countries. But after coordination with representatives of the Mexican smuggling cartels with be given a green light to enter the USA unlawfully when the borderline is effectively bum rushed by the tens of thousands of waiting illegal aliens in the next few days.

Article assumes that the current administration will adhere to the SC ruling.

It's not asylum. It's economics.

Yes, title 42 has worked so well, it has held the illegals to, what, 2 million.

I am no immigration expert - have to do some research later today but I thought there were already federal legal restrictions in place that allowed sick immigrants seeking entry to be denied entry into the USA. Of course, when my grandparents immigrated here circa 1900 - there were health requirements before you were allowed entry. Ah the good old days....
Per the National Park Service website, Ellis Island for about a 50 year period or so processed about 12 million LEGAL immigrants. Over 2 million and counting in two years thanks to the Dems.

#6, Title 42 is not the problem. It worked beautifully under an administration which actually enforced it. Unlike the current one. Blame the millions of invaders on Biden and Mayorkas, not on the law.

When I immigrated (legally) in the '70s had to go through a thorough physical exam and all the reports and X-Rays were attached to the visa document which was carefully examined at the point of entry. Now of course all you have to do is to crawl through a neatly cut hole in the fence. Rule of law is a thing of the past. How in good conscience those who rule us can put someone in jail without trial for two years for sauntering through a government building at the invitation of authorities remains unclear to me!

Isn't it odd that this Trump era policy stymies a 'flood' while many thousands are virtually welcomed across our border?

These people are not seeking asylum.
They are seeking a better life in America and I can easily understand that, The problem is they should be doing it in a legal manner, and also there is a limit to how many our economy and burden on taxpaying citizens can stand.

Title 42 is a joke in the corrupt clutches of Biden and Mayorkas. Last weekend more than 14k illegal aliens were taken into custody by CBP. 2000 were expelled under 42; more than 12k were released into the interior of the US. A. Total. Joke.

I agree that Title 42 should stay in place simply to to help stem the tide of illegals. However, as written, Title 42 is written as a Covid "health care crisis" policy. That crisis is over so technically Title 42 should end. As much as I hate to agree with the Justice Gorshich, he is correct in his reasoning for his decision. The Supreme Court is not the one that should be addressing this situation. The cowards in Congress and the Executive branches need to address it through legislation and policy. Kicking the responsibility over to the Supreme Court is the cowards way out and Gorsich calling them out deserves praise, not scorn. Congress must address the illegal immigration invasion and Biden (the Executive Branch) must actually acknowledge that it exists!

Well, I'm glad it was extended...
Not that it really matters in practice though. All they have to do is get across the border, and they are welcomed with open arms and open taxpayer wallets by the feds and by the Democrat governors of New Mexico, California and next week, Arizona.
The only ones that Title 42 is used to turn back are those suspected of possibly being conservatives.
