DENVER (AP) — In the summer of 2020, Gerard Magliocca, like many during the coronavirus pandemic, found himself stuck inside with time on his hands.
A law professor at Indiana University, Magliocca emailed with another professor, who was writing a book about overlooked parts of the Constitution’s 14th Amendment. He decided he would research the history of two long-neglected sentences in the post-Civil War addition that prohibit those who “engaged in insurrection or rebellion” from holding office.
Magliocca posted a copy of his research — which he believed was the first law journal article ever written about Section 3 of the 14th Amendment — online in mid-December of 2020,

Someone needs to point me to the judicial decision that found Trump guilty of insurrection. The sham J6 committee doesn't qualify. Opinions from judicial pundits don't qualify. TDS doesn't qualify.
To date, he hasn't been found guilty of anything other than hurting some NY harlot's feelings.

Funny how demorats ignore the issue of who determines that someone has engaged in insurrection. If all it takes is an unsupported accusation and not a conviction in a court of law, I hereby accuse Joe Biden of insurrection.

What a load of HOOEY. An entire truckload of bull manure. President Trump has not been CHARGED in any court with insurrection. There WAS NO 'insurrection', just some Capitol Police murdering trespassers.
And no conviction for these things that NEVER happened.

I don’t think there are any sentences in the Constitution that “rise from obscurity.” The Constitution is well known in all its parts; it is a very brief document.
But until these Banana Republic Lawfare apes came along trying to turn everything into a banana, these provisions were not litigated because they didn’t need to be for nontyrants.

Didn't you find it exceedingly odd that from Day 1 all the Democrats and everyone in their media used that same unusual word -- "insurrection" -- to describe the events of January 6? Now you know why. They knew Trump would be back in 2024 and were already plotting, in January 2021, to lay a Constitutional foundation for disqualifying him. The plot will fail, of course, but give them credit for being devious.

Consider three things -coolly and rationally
1.Trump has already been tried by the Senate for insurrection. resulting in acquittal
2. The ONLY recourse against the actions of an unconvicted President is impeachment by Congress. The Judicial branch is powerless
3. Section 3 applies to Officers of the United States. Which the Constitution defines as individuals appointed by the President. The President can hardly appoint himself (though 0bama would have like to try)
3A. Any reasonable analysis untainted by TDS, will show that Article 3 was never intended to apply to a President of the US.
They are barking up the wrong tree!

They were long neglected, because...the ONLY insurrection/rebellion by any active politicians was 150 years ago...and even those who took up guns, fired them, led combat troops and TOOK THOUSANDS OF LIVES were not even barred from office by those same words.

Tired of the whining about how unfair it is to use Civil War obscure language to disqualify a candidate. Take action. Every single Rebublican AG should announce that the second the Supreme Joke rules Democrat judges and unelected Democrats can declare who is an insurrection will be the second d they disqualify Diaper Joe.
